§ 1 Applicability

  1. These Consumer Terms of Use apply to all legal relationships between AutoMarktSU and the User.
  2. By visiting the website, using information on the website, or submitting data, the User agrees to these Terms.
  3. AutoMarktSU may amend these Terms at any time. Continued use of the platform constitutes acceptance of the amended Terms.
  4. Separate terms apply to business users.

§ 2 Services Provided by AutoMarktSU

  1. AutoMarktSU provides a digital platform that enables Sellers and Buyers to connect. AutoMarktSU is not a party to any transaction and acts solely as a technical facilitator.
  2. AutoMarktSU may inform Registered Users about advertisement performance, promotional options, and alternative selling methods.
  3. Information on the website is intended for general guidance only.
  4. AutoMarktSU does not guarantee the accuracy, completeness, or reliability of information provided by third parties.
  5. AutoMarktSU may modify the design, functionality, or presentation of the website without any obligation to compensate Users.

§ 3 Registration

  1. Registration is only permitted for individuals who are legally competent and at least 18 years old.
  2. Users must provide accurate information and keep their details up to date.
  3. Login credentials must be kept strictly confidential.
  4. Personal data is processed in accordance with the AutoMarktSU Privacy Statement.
  5. AutoMarktSU may delete inactive accounts.
  6. AutoMarktSU may block accounts that violate these Terms or harm the platform's interests.

§ 4 Advertisements

  1. Only Registered Users may submit data for advertisements.
  2. Each User may have a maximum of two active advertisements and no more than two different advertisements per calendar month.
  3. Advertisements remain visible for up to eighteen weeks unless removed earlier by the User.
  4. AutoMarktSU determines the sorting and ranking of advertisements. Paid options may increase visibility.

§ 5 Responsibility for Content

  1. The User is fully responsible for the content of their Advertisement.
  2. The User guarantees that the content:
    • does not violate any laws
    • does not infringe third-party rights
    • does not contain offensive, misleading, or harmful material
    • is complete and accurate
  3. The User must immediately correct or remove any unlawful or incorrect Advertisement.
  4. The User indemnifies AutoMarktSU against all third-party claims arising from their Advertisement.
  5. The User guarantees that submitted files do not contain malware.

§ 6 Moderation, Blocking, and Sanctions

  1. AutoMarktSU reviews advertisements through automated systems and manual checks.
  2. Illegal content may be reported; such reports are reviewed by the moderation team.
  3. In case of violations, AutoMarktSU may:
    • remove advertisements
    • limit visibility
    • delay publication
    • issue warnings
    • temporarily or permanently suspend accounts
  4. Measures depend on the severity, frequency, and intent of the violation.
  5. Users may file an internal complaint within six months of a decision.
  6. Users may escalate unresolved disputes to a recognized alternative dispute resolution body.
  7. Abuse of reporting tools may result in suspension.

§ 7 Usage Rights

By submitting data, the User grants AutoMarktSU:

  • a worldwide, royalty-free, sublicensable license to use, reproduce, distribute, and publish the Advertisement
  • the right to archive and store the data
  • the right to edit, shorten, or combine the data with other content

AutoMarktSU may outsource these rights to third parties.

§ 8 Database Rights

  1. All intellectual property rights relating to the website and database belong to AutoMarktSU.
  2. It is prohibited to copy, reuse, or automatically extract any part of the database without written permission.

§ 9 Warranty

  1. AutoMarktSU does not guarantee the accuracy, completeness, or reliability of User-provided information.
  2. Advertisements are submitted by third parties; AutoMarktSU is not responsible for their content.
  3. AutoMarktSU does not guarantee uninterrupted or error-free operation of the website.

§ 10 Indemnification and Liability

  1. AutoMarktSU is never a party to transactions between Users and excludes all liability for damages arising from such transactions.
  2. AutoMarktSU is not liable for damages resulting from:
    • inaccurate third-party information
    • the quality or legality of advertised vehicles
    • false identities or misrepresentation by Users
    • technical failures
    • refusal or removal of advertisements
    • links to third-party websites
  3. If AutoMarktSU is liable despite these exclusions, liability is limited to direct damages only.
  4. AutoMarktSU is never liable for indirect damages, including lost profits or data loss.
  5. Liability is limited to the amount paid out by AutoMarktSU's insurer.
  6. These limitations also apply to AutoMarktSU employees.

§ 11 Third-Party Websites

AutoMarktSU is not responsible for the content of third-party websites linked on the platform.

§ 12 Termination

  1. Users may delete their account at any time.
  2. AutoMarktSU may terminate services with 14 days' notice.
  3. AutoMarktSU may terminate services immediately in case of violations of these Terms.

§ 13 Accessibility (Suriname + voluntary international standards)

AutoMarktSU aims to make its digital services accessible to all users, including individuals with visual, auditory, motor, or cognitive impairments. Although AutoMarktSU operates under the laws of the Republic of Suriname and is not legally required to comply with European accessibility regulations, the platform strives, where reasonably possible, to align with internationally recognized standards such as the Web Content Accessibility Guidelines (WCAG 2.2 AA) and the principles of the European Accessibility Act (EAA).

These efforts are intended to enhance user experience, promote inclusivity, and ensure broad accessibility. AutoMarktSU reserves the right to implement accessibility measures at its own discretion and within reasonable technical and organizational capabilities.

§ 14 Final Provisions (Suriname)

  1. All legal relationships between AutoMarktSU and the User are governed by the laws of the Republic of Suriname.
  2. Disputes shall be submitted exclusively to the competent court in Paramaribo, unless mandatory law dictates otherwise.
